The terms that apply when you buy and use SmartGolf AIX and the SmartGolf app.
SmartGolf grants you the right to use this website subject to these Terms of Use. The purchase of any product or service through the site is also governed by these terms. By accessing or using the site, you agree to these Terms of Use and are bound by them. If you do not wish to be bound, please do not access or use the site. We may change these terms from time to time, and continued use of the site means you agree to the most current version, so please review this page regularly.
Prices are shown in U.S. dollars and payments are processed securely by PayPal. You may pay in full or, where offered, through an installment plan. An order is confirmed once payment is authorized. We may cancel and refund an order if an item is unavailable or if a pricing error occurs. To make a payment you provide the payment service with a valid payment method and the associated details, and you authorize us or our payment providers to charge that method for all amounts due for your purchase. Please notify us of any change to your billing details.
Where an installment option is offered, you pay an initial amount at checkout and the remaining amount in scheduled monthly payments for the stated term. The plan is intended to run for its full term.
If you cancel or stop the installment plan before it is complete, the entire remaining balance becomes immediately due and may be charged to your payment method on file in a single payment. Keeping a valid payment method on file for the duration of the plan is your responsibility.
If you change your mind, you may request a return within 14 days of delivery, provided the product is unopened and unused in its original, sealed packaging.
The SmartGolf app and its content are continuously updated and improved as part of ongoing product upgrades, so features, courses, and content may change, be added, or be removed over time.
SmartGolf devices and the SmartGolf app automatically record and accumulate the swing data generated when a member practices or plays a round. This data includes swing count and timestamp, club type, club speed, smash factor, club path and face angle, address and impact angles, calculated carry distance, and the accuracy score derived from them.
Collection, use, and retention of personal information are governed by our Privacy Policy.
SmartGolf is the sole owner and operator of the site. The content and information on the site are protected by copyright. SmartGolf grants a limited license to reproduce site content for its current and potential stakeholders (for example current and potential customers, applicants, and business affiliates). All copyright and proprietary notices, including brand names, must be retained on any copies. Any unauthorized reproduction, distribution, or modification of the site content is prohibited. SmartGolf and its affiliates reserve all rights not expressly granted.
The brand names, logos, graphics, and trade names used on the site are trademarks of SmartGolf and may not be used without permission, or in connection with any third-party product or service. Other trademarks or service marks on the site are the property of their respective owners.
We reserve the right to modify, suspend, or discontinue the site or any part of it, and to modify the site content, with or without notice. SmartGolf will not be liable to you or any third party for any such modification, suspension, or discontinuance.

SmartGolf does not control and is not responsible for the content of those sites, which are the responsibility of the third parties that operate them. We provide these links for convenience and do not review, endorse, or monitor them.
SmartGolf provides a limited warranty (365 days) on products purchased through the site and authorized resellers. See the Warranty page, which is incorporated into these Terms.
The site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, SmartGolf will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the site or its content, including any loss of use, data, or profit. Except as provided in the terms of sale, our total cumulative liability in connection with the site or its content will not exceed twenty U.S. dollars ($20); liability relating to a product you purchase will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
SmartGolf may revise and update these Terms of Use at any time. By using the site you agree to be bound by the then-current version, so we recommend that you review this page regularly.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision will be modified to the extent needed to make it valid. These Terms and any related action are governed by the laws of the State of California, United States. Warranty claims are governed by the law of the country of original purchase (see Warranty).
